I. INTRODUCTION
A. SUMMARY
Based on applications filed by eligible entities and the funds available in the Public,
Educational and Governmental Programming and Education Technology Investment
Account (PEGPETIA), the Public Utilities Regulatory Authority (Authority) allocates
$7,155,945.15 in grants.
B. BACKGROUND AND CONDUCT OF THE PROCEEDING
In 2007, the General Assembly established the PEGPETIA program to promote
and improve public, educational, and governmental programming and to support
education technology initiatives. See Public Act 07-253, An Act Concerning Competitive
Video Services (codified at Conn. Gen. Stat. § 16-331cc). The account is funded by a
quarterly tax on the gross earnings of video service providers.
In 2008, the Authority established the application requirements through a
contested proceeding and, subsequently, revised the requirements in 2019. See

Proceeding to Establish Administrative Guidelines for the Public Educational and
Governmental Programming and Education Technology Investment Account – Grant
Eligibility Criteria and Guidelines (Revised Guidelines Decision).
The Authority conducts an annual proceeding to determine the allocation of the
accumulated funding in the account and to administer grants to eligible entities.
To distribute PEGPETIA funds accumulated through February 28, 2023, the
Authority opened this proceeding and began accepting applications on November 1,
2022, through February 28, 2023. The Authority received a total of 92 applications. The
Authority delegated the review of the applications to its Office of Education, Outreach,
and Enforcement (EOE) and directed EOE to file a motion with a draft proposed decision.
EOE filed the motion on May 11, 2023.
The Authority reviewed and considered EOE’s draft proposed decision and issued
a substantially modified proposed decision on May 22, 2023. The participants were
provided with an opportunity to file written comments on the proposed decision. The
Authority received written comments from East Granby Public Schools and Nutmeg
Public Access Television, Inc. (Nutmeg).

II. AUTHORITY ANALYSIS
A. APPLICATION AND ELIGIBILITY REVIEW
Applicants must submit complete applications and meet the eligibility requirements
established in the Guidelines Decision and Revised Guidelines Decision. In addition, to
maintaining eligibility, applicants must demonstrate compliance with any requirements
from prior PEGPETIA grants. Non-compliance with previous orders disqualifies an
applicant from receiving funds through the current cycle.1
This year, 92 applications were submitted via motion; however, two of the
applications were deemed ineligible due to the applicants’ non-compliance with one or
more orders from last year’s grant award. The table below indicates the ineligible
applications and the associated non-compliance.

Each award recipient is responsible for complying with the conditions and
requirements of a grant award and for updating the recipient’s contact information to

B. ALLOCATION OF PEGPETIA FUNDS
For this grant cycle, the amount of funding available in the PEGPETIA account is
$7,741,331. This amount represents an unusually significant increase over prior annual
funding, which generally ranges from $2 - $3 million. Given the magnitude of deviation, the
Authority will distribute $7,200,000 in grants and reserve the remainder for potential
accounting or funding variances.
Fifty percent (50%) of this amount, or $3,600,000, is to “be available for local
community antenna television and video advisory councils; the state-wide video advisory
council; public, educational and governmental programmers and public, educational and
governmental studio operators . . . .” and fifty percent (50%) is to “be available to boards
of education and other education entities for education technology initiatives.” Conn. Gen.
Stat. § 16-331cc(b).

As stated, 92 applications were submitted, with 2 deemed ineligible. Of the 90
eligible applications, 31 are seeking a total of $3,055,535 for “public, educational and
governmental” programming or studios (PEG Grants) and 59 are seeking a total of
$6,686,922.17 for “education technology initiatives” (ETI Grants).2 Because the requests
for PEG Grants were less than the $3,600,000 available for PEG Grants, the Authority
used the residual for ETI Grants.3 The table below summarizes the allocation of funding.

The tables below provide the specific grant award for each eligible application.
To allocate the $4,144,465 in funding available for the $6,686,922 ETI Grant requests,
the Authority applied a cap of $91,000 on ETI Grants.
These award amounts may be applied towards any capital expense listed in the
original application. As a result of the cap on ETI grants, some awardees may need to
scale down their original project plans and complete a smaller version of the proposed
project. If an awardee is unable to do so, the funds must be returned. If there are
questions about a scaled-down version of an applicant’s project meeting the PEGPETIA
guidelines or the appropriateness of a substituted capital expense, please contact Nancy
Joaquim at nancy.joaquim@ct.gov. Any unused funds must be returned to the DEEP
Business Office prior to receiving a new grant award.

No. 45) and Regional School District 7 (Motion No. 93) as recipients of PEG grants rather than ETI
grants. After further review of the applications, the Authority confirms that the grants are correctly
classified as PEG Grants because both schools are asking for capital and equipment costs to produce
or procure programming on public access stations. The Authority will review applications on a yearly
basis to determine whether they may be classified as a PEG or ETI grant. Furthermore, the Authority
may seek clarity on whether its classification of grants under Conn. Gen. Stat. § 16-331cc (b) is
consistent with the General Assembly’s intent as part of its study conducted in Docket No. 22-06-26,
PURA Study of the Operations of Certified Third-Party Nonprofit Community Access Programming
Providers.

III. CONCLUSION AND ORDERS
A. CONCLUSION
The Authority awards PEG Grants and ETI Grants to the entities and in the
amounts identified in the respective tables above.
B. ORDERS
For Orders requiring a compliance filing, file an electronic version through the
Authority's website at www.ct.gov/pura. Submissions filed in compliance with the
Authority’s Order must be identified by all five of the following: Docket Number, Title,
Decision Date, Order Number and Motion Number.
1. No later than June 30, 2023, awardees must complete, sign and return a
completed Form W-9 and Agency Vendor Form (appended to this Decision) via
e-mail to the DEEP Business Office (Teddi.Ezzo@ct.gov).
2. No later than October 18, 2023, awardees must file copies of all receipts and/or
paid invoices for equipment and approved costs purchased with grant funds. All
unused funds must be returned to the DEEP Business Office prior to receiving a
new grant award.
3. No later than February 15, 2024, PEG grant awardees must file a report providing
the title, subject, and duration (in minutes) of all community access programs
facilitated in whole or in part by the grant award. The report shall also identify how
the programs were distributed through community access channels and shall
discuss the protocols for ensuring that any programs produced with equipment

purchased with PEGPETIA funds are made available to the applicant’s local PEG
studio.
4. No later than February 15, 2024, all awardees will file an overall account of the
project enabled by the grant funds.
